Court Sends StubHub Class Action Over CEO's Ticket Fund to Arbitration
A federal judge ruled that StubHub's terms of service require individual arbitration, blocking a class action lawsuit over CEO Eric Baker's ticket-reselling fund. The plaintiff had alleged he wouldn't have used StubHub if he knew about the fund. The case will now proceed in private arbitration.
The ruling stems from a July lawsuit by Louis Sanquini, who purchased KISS concert tickets through StubHub. He claimed he would have taken his business elsewhere had he known about CEO Eric Baker's connection to Andro Capital, a ticket-reselling fund that has operated on the platform since 2008 and earned over $5 million there since 2022.
StubHub disclosed Baker's ownership in regulatory filings ahead of its $758 million IPO last year, describing Andro Capital as one of many vendors contributing a small share of revenue. Judge Rakoff's decision addresses only the forum, not the merits, leaving Sanquini's attorney to pursue individual arbitration claims, which he says could number in the thousands.
This ruling could shape how consumers pursue grievances against large ticketing platforms. By enforcing arbitration clauses, the court may limit collective legal action, potentially reducing the deterrent effect of class-action lawsuits. Individual arbitration may be impractical for many ticket buyers with modest claims, though the plaintiff's attorney suggests thousands of individual cases could still pressure StubHub.
