CMS Issues Guidance on Medical Frailty Exception for Medicaid Work Rules
CMS released guidance explaining how states might define “medical frailty” for Medicaid work and community engagement exceptions under H.R. 1. The guidance sets out three tiers of medical conditions and evidence, with Tier 1 linking certain diagnoses to work impairment, Tier 2 requiring supporting clinical information, and Tier 3 allowing case-by-case review. States are not required to adopt the framework.
Congress set Medicaid work and community engagement conditions in H.R. 1, the budget reconciliation law also called the One Big Beautiful Bill Act. It exempted people deemed medically frail but left key terms undefined, assigning states much of the task. The statute named blindness, disability, disabling mental or substance use disorders, serious or complex conditions, and physical, intellectual, or developmental disabilities affecting daily activities.
CMS's new guidance offers an optional three-tier framework. Tier 1 pairs listed diagnoses with presumed work impairment. Tier 2 relies on added clinical evidence, such as prescriptions, equipment use, or utilization data. Tier 3 leaves harder cases to individual review and documentation. States may adopt, adapt, or ignore it.
The guidance could influence how states identify exemptions, affecting Medicaid applicants and enrollees with chronic illness, disabilities, or substance use disorders who must document frailty. Where states adopt different tiers, coverage outcomes may vary by location. Administrators and providers may face added verification duties, while eligible people could lose coverage if evidence is hard to assemble. The framework’s optional nature may produce uneven implementation across states.
