EU Regulation Sets Up Cross-Border Digital Identity for Healthcare
The EU has adopted Commission Implementing Regulation (EU) 2026/2099 to create cross-border digital identity and authentication for healthcare under MyHealth@EU. It links the European Health Data Space with eIDAS 2.0 and aims to let patients, clinicians, and organizations exchange trusted identity data across member states. The framework envisions EUDI Wallets as sector-specific tools, with a phased rollout from 2027 to 2032.
The implementing regulation was adopted on 21 September 2026 and published the following day in the EU Official Journal. It builds on the European Health Data Space Regulation (EU) 2025/327, in force since 26 March 2025, which requires MyHealth@EU to connect national digital health systems through designated national digital-health contact points.
Article 16(2) of that earlier regulation authorized the Commission to set common technical rules for authenticating cross-border participants. Regulation (EU) 2026/2099 answers that mandate by tying MyHealth@EU to eIDAS 2.0 (Regulation (EU) 2024/1183), moving from the older eIDAS framework’s voluntary approach to notified national electronic identification schemes and certified EUDI Wallets.
Patients receiving care outside their home country may encounter fewer information gaps, less repeated testing, and lower risk of adverse events if clinicians can reliably verify identity and access records. Healthcare professionals and organizations could see clearer authentication and reduced administrative overhead. The phased 2027–2032 rollout may shape how quickly these benefits are felt, depending on consistent adoption across member states.
