Five Key FAR Overhaul Proposals for Government Contractors

The Federal Acquisition Regulatory Council issued a second set of proposed rules on September 18, 2026, including FAR Case 2026-003. The proposal would revise several FAR parts and restructure Part 12 to emphasize commercial products and services. Comments are due October 19, 2026, and contractors should monitor changes affecting commercial acquisitions, competitive procurements, proposal preparation, and negotiations.
The proposal is the second set of FAR overhaul rules from the Federal Acquisition Regulatory Council, issued Sept. 18, 2026. FAR Case 2026-003 would touch Parts 8, 12, 13, 15, 38, 44, 51 and related Part 52 clauses. Public comments close Oct. 19, 2026.
Part 12 would be reorganized around acquisition stages—presolicitation, solicitation/evaluation/award, and post-award administration—and would consolidate certain commercial-buying procedures now in Parts 5, 12, and 13. Part 15 would emphasize negotiation over discussions and allow greater contracting-officer flexibility.
Government contractors, especially smaller firms selling commercial goods or services, could face changed solicitation structures, proposal expectations, and negotiation dynamics. Agencies may gain flexibility in commerciality determinations and competitive-range talks, which could affect bid strategies and compliance costs. Because comments close soon, affected businesses may wish to assess whether the proposals clarify or complicate procurement, though actual effects will depend on final rules and implementation.
