Pentagon Downgrades Top Guantanamo Military Commission Legal Roles
Secretary Hegseth has issued an order that will reduce the ranks of the two highest-ranking lawyers on the Guantanamo military commissions starting in January. The change affects the leadership of the legal teams involved in those commissions.
Hegseth’s Sept. 16 order removes 23 general-officer positions, including the Guantanamo chief prosecutor and chief defense counsel posts. Starting Jan. 1, those jobs will be capped at O-6—colonel or Navy captain. The current officeholders are Rear Adm. Aaron Rugh and Brig. Gen. Jonathan Vaughn.
The ranks were raised during the Obama administration: Brig. Gen. Mark Martins led prosecutions from 2011, and Brig. Gen. John Baker headed defense from 2015. The change comes as jury selection is scheduled in Abd al-Rahim al-Nashiri’s USS Cole capital case.
Reducing these legal leadership posts could alter how much influence the commissions’ prosecution and defense teams carry within the Pentagon, potentially affecting staffing, resources, and continuity during the USS Cole capital case.
