Supreme Court Permits DHS Voter Checks Using Citizenship Database Before Midterms
The Supreme Court ruled 6-3 to allow Homeland Security to use a searchable citizenship database compiled from Social Security records to verify voters ahead of the midterm elections. In dissent, Justice Ketanji Brown Jackson argued that the burden on a small number of eligible voters is greater than any harm from preventing an action the government probably has no legal power to take. A lower court had previously blocked the database over privacy concerns, and reporting noted that it had incorrectly flagged citizens in Missouri.
The justices split 6-3, allowing Homeland Security to resume using a citizenship lookup assembled from Social Security records for voter verification ahead of the midterms. Justice Jackson dissented, writing that imposing burdens on even a few eligible voters outweighs any harm from halting an action the government likely lacks authority to take.
Earlier reporting noted that 70 Missouri county clerks from both parties warned lawmakers the system repeatedly misidentified citizens. In St. Louis County, over one-third of those flagged had registered on the day they naturalized. The court acted the same day it blocked a Missouri redistricting map.
The decision may affect eligible voters whose records are incomplete or mismatched, potentially adding verification hurdles before midterms. Election officials could face pressure to resolve false flags quickly, while privacy advocates may challenge expanded data use. If errors fall disproportionately on newly naturalized citizens, as prior Missouri warnings suggested, trust in election administration could suffer.
