Paxton Senate Bid Seen as Potential Springboard for Federal Abortion Limits

Allies and legal experts believe a U.S. Senate victory by Texas Attorney General Ken Paxton could lead to federal anti-abortion restrictions. They expect him to push for limits on mifepristone, IVF rules, and emergency abortion guidance, building on his Texas record. Paxton previously backed near-total bans and private enforcement mechanisms.
Before becoming attorney general, Paxton had co-sponsored a Texas Senate proposal barring nearly all abortions after 20 weeks. After Roe was overturned, Texas adopted a ban carrying prison terms of up to 99 years for doctors. Earlier, the state’s 2021 law relied on private lawsuits, with $10,000 available to successful plaintiffs, and the Supreme Court let it operate while Roe remained law.
Paxton later challenged federal emergency-care guidance. A judge ruled for him in 2022, and the Fifth Circuit affirmed in 2024, blocking enforcement in Texas and shielding named plaintiffs. The resulting split with the Ninth Circuit helped Idaho seek Supreme Court permission to enforce its ban, which the Court allowed in January 2024.
If Paxton reaches the Senate and advances federal restrictions, patients and clinicians in states with abortion bans could face added barriers to medication abortion, emergency care, and fertility treatment. Hospitals may confront conflicting federal and state expectations, potentially delaying time-sensitive care. Families
